This John MAYES was born 1 March 1766 in Union District, South Carolina.
He was the son of Thomas MAYES and Jean RUTHERFORD. His wife was Margaret
CRAWFORD.
WILL OF JOHN MAYES
In the Name of God Amen.
I John Mayes
of the State of Georgia and County of Franklin being weak in body yet in my
sound mind and understanding for which I thank God do make, apoint and ordain
this my last Will and Testament written with my own hand.
All my just
debts which are but few and none of any great amount I wish them to be
punctually paid as soon as the debts coming to me can be collected.
To my dearly
beloved wife Margaret Mayes I give and bequeath the use of my whole estate real
and personal during her natural life except such part as are otherwise desposed
of hereafter. My negro girl Rebeckah I give to her to do and despose of as she
may _________ proper at her death. The tract of land I first bout and now live
on I give her during her natural life.
The tract of
land I bout of James Lowrey on which my son Newton lives on I give him the use
of as long as he sees proper to live on.
The tract
which I bout of Charles Lowrey I give the use to my son Harvey and at my wife's
death all my land is to be equally divided between my three sons Edward,
Newton, and Harvey and it is my desire that Edward would come and live on the
Plantation with his mother and when my son Harvey and my two daughters are
married that he would come and live in the house with her and at her death the
house and other buildings should be on his part of the land.
To my son
Robert I give and bequeath one half of the note I hold on Alexander and George
Crawford for two hundred dollars. The other half I give and bequeath to my two
daughters Malinda and Synthy to be equally divided between them when they come
of age. Likewise each of them a good horse, sadle and bridle, cow and calf, bed
and furniture and all they can make within themselves to be their own
afterwards.
And at my
wife's death all the balance of my estate I desire to be equally divided
between all my sons and daughters namely Thomas, William, Jane Turk, James,
Isabella Thomas, Edward, Robert, Newton, Harvey, Malinda and Synthy.
Lastly I
constitute and apoint my son in law William Turk and my son Edward Mayes my
executors.
