Deed, Kempt and Sukey Hurst to John Mays

This indenture made the Twenty Sixth Day of
September in the ninth year of the Reign of our Soverign Lord George the Third
by the Grace of God of Great Britain France & Ireland Kind Defender of the
faith andS. Anno Domini, one Thousand Seven Hundred and Sixty Nine Between
Kempt Hurst and Sukey his Wife of the Parish of Niccocomico in the County of
Northumberland of the One Part and John Mays of the same Parish and County of
the Other Part, Witnesseth that he the said Kempt Hurst and Sukey for and in
Consideration of the Sum of Forty five pounds current money of Virginia to them
in hand paid by the said John Mays the Receipt whereof he the said Kempt Hurst
and his Wife Doth hereby confess and acknowledge themselves therewith fully
contented and paid hath given, granted, bargained and sold, remised, released,
enfeoffed and confirmed and by these presents doth give, grant, bargain, sell,
remise, release, enfeoffed and confirmed unto the said John Mays his heirs and
assigns forever a certain Tract and Parcell of Land situate lying and being in
the aforesaid County and Parish and on the north side of Scotland Mill Creek
formerly known by the name of Damerons Creek and Empty's ~ Near the Mouth of
Wiccocomico River on the South Side, which said tract and parcell of Land is
bounded as followith ~ viz., Beginning at the Mouth of Muddy hole branch thence
up the said branch to a marked White Oak Standing Near the Said branch on the
East Side from thence a Straight Line to a marked Red Oak Corner to Nelms's
Land and the Land of the said Kempt Hurst ~ from thence along a line of Marked
Trees in Nelms's Line to a corner Red Oak, thence a long Suttan's Line to
Judith Howsins Land to a Cedar Post a Corner to this and the Land of Judith
Howsin, then southerly along Judith Howsin's Line to a black Gumm Tree Standing
near the side of a small Cave below Travis Dameron's Mill Dam, from thence Down
the several meanders of Scotland Mill Creek to the beginning at the Mouth of
Muddy Hole branch. Including and containing ninety four acres, be the same more
or less, it being one half of one hundred acres of Land George Dameron ~ Late
of this County Purchased of Alexander Cummin and Sarah his wife one of the
coheirs of John Matton ? (can read name clearly) , by Deed dated the
Seventeenth Day of October One Thousand Seven hundred and sixteen, Also one
half of one hundred acres of Land Purchased by the aforesaid George Dameron of
Henry Robinson and Mary his Wife by Deed bearing Date the fourth day of
December One thousand and Seven hundred and Eleven, Relation being had to the
said Deed may more fullyal Large appear, which said Two hundred Acres of Land
has been divided between the two only daughters of the said George Dameron
deceased, namely N Elizabeth Waddy and Judith Howsin being coheirs to the said
Dameron Estate, which said Ninety four acres of Land with the Appurtenances was
purchased of the aforesaid Elizabeth Waddy by Thomas Hurst by ~ Deed of Sale Dated
the Thirty first Day of January One Thousand Seven hundred and Fifty Three, and
by the Last Will and Testament of the said Thomas Hurst given to Kemp Hurst the
first party to these Presents, which said Ninety-four acres of Land together
with all Woods, underwoods, waters, water courses, meadows, pastures, fencings,
houses, orchards, gardens, marshes and fordges unto the said ninety-four acres
of Land or in any wise appertaining or therewith used, occuppyed or enjoyed,
together with all Rights priviledges, advantages and appurtenances to the same
or to any part thereof apurtaining and the revisions and reversions, remainder
and remainders rents and profits thereof to have and to hold the said
ninetyfour acres of land with the promises and appurtenances and every part and
parcell thereof, hereby granted, bargained and sold with ever priviledge and
advantage thereto ~ appertaining unto the said John Mays his heirs, exec. And
Adm. To the only proper use and behoof of him the said John Mays his heirs exec
and admrs. Forever, yielding and paying the quitrents for the same as of right
accustomed, and the said Kemp Hurst for himself his heirs, exec., and admirs.
That at the time of the ensealing and delivery of these presents hath in
himself good right full power and lawfull authority to grant and convey the
said niety four acres of land in manner and form aforesaid and that the said
John Mays his heirs and assigns shall and may from time to time and at all
times hereafter have hold, occupy and possess and enjoy the same and every part
and parcell thereof without the least hinderance and molestation of him, the
said Kemp Hurst, his heirs, exec. Or admrs. Or any other person or persons
whatsoever claiming or to claim from, by or under him, them, or any of them,
free and clear and freely and clearly acquited, exonerated and discharged of
and from all manner of jointures, dowers, gifts, grants, bargains, sales,
leases, mortgages, judgments, executions and eschets and from all manner of
trouble whatsoever committed and done by the said Kemp Hurst his heirs
executors. And administrators or any other person or persons pretending any
claim to the same and shall and will warrant and forever defend the aforesaid
Land and Premises unto him the said John Mays his heirs and assigns forever,
and will from time to time and at all times hereafter at the reasonable request
cost and charges of him the said John Mays his heirs and assigns do, levey,
suffer acknowledge or cause to be made done leveyed and acknowledge all or any
other Deed conveyance or conveyances, assurance or assurances in the Law,
whatsoever, for the more perfect and sure conveying an absolute fee simple
estate in all the aforesaid Lands & Premises unto the said John Mays his
heirs and assigns forever, as his councill in the Law shall in that behalf
reasonably devise advise & require. And Lastly the said Kemp Hurst doth
covenant and promise that he and his wife Sukey will acknowledge this Deed in
Northumberland County Court at the first Court Held for this County unto the
said John Mays his Heirs and Assigns Or at any time afterward when Required by
the said John Mays his Heirs Exec. Admrs. And assigns. In Witness whereof the
said Kemp Hurst and his wife to this present Indenture hath sett their hands
and affixed their seales the day & Year above Written ~
